1. Acceptance of Terms

By accessing or using the Moments Imprinted website and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service.

We reserve the right to update or modify these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page and notify registered users by email. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

2. Eligibility

You must be at least 18 years of age to create an account and use the Service. By registering for an account, you represent and warrant that you are at least 18 years old and that you have the legal capacity to enter into a binding agreement. If we learn that an account has been created by someone under the age of 18, we will terminate that account immediately.

4.1 Subscription Plans

We offer two membership tiers, each billed annually. Signing up for a membership is free — your annual membership fee is only charged when your first card is approved for printing. Your membership determines your per-card rate:

Without an active membership (One Moment), cards are available at the default rate of $8.49 per card.

4.2 Billing

All payments are processed securely through Stripe. Your annual membership fee is not charged at sign-up. Instead, it is collected alongside your first card payment when a card is approved for printing (either manually by you or automatically after the editing window expires). For example, if you are on the Many Moments plan, your first card charge will be $24.99 (annual fee) + $4.99 (card fee) = $29.98. Subsequent cards are charged at your per-card rate only. Your membership renews annually on the anniversary of your first card payment date.

4.3 Cancellation

You may cancel your membership at any time through your account settings. Upon cancellation, your membership benefits remain active until the end of your current billing period. After that, any future card orders will be charged at the default per-card rate of $8.49. If your membership fee has already been collected (with your first card payment), it is non-refundable. If you cancel before your first card is sent, no membership fee will be charged.

5. Event Scheduling and Card Delivery

5.1 Scheduling

Events should be scheduled at least 2 weeks in advance to allow for the notification, editing, printing, and mailing process. Three weeks before each event, you will receive an email preview of the card. You then have a 1-week window to make changes to the card design, message, or recipient details.

5.2 Auto-Approval and Deemed Acceptance

If no changes are made within the 1-week editing window, the card will be automatically approved, charged to your payment method, and sent to print. This ensures timely delivery for your event.

5.3 Delivery

We make every reasonable effort to ensure cards arrive before the event date. However, we cannot guarantee specific delivery dates as mailing times depend on postal service conditions. We are not responsible for delays caused by incorrect addresses, postal service disruptions, or events scheduled with insufficient lead time.

As a user of the Service, you agree to:

Moments Imprinted reserves the right to refuse to print any card that, in our sole discretion, violates this content policy. Repeated violations may result in account suspension or termination.

6.2 Collect My Dates Feature

The Service includes a "Collect My Dates" feature that allows you to generate a unique, shareable link. When you share this link with friends, family members, or other third parties ("Submitters"), they can voluntarily provide their personal information — including their name, birthday, mailing address, and other special dates — through a public form. No account is required for Submitters to use this form.

By using the Collect My Dates feature, you acknowledge and agree to the following:

6.3 Submitter Consent and Data Handling

When a Submitter fills out a Collect My Dates form, they are presented with a clear notice that their information will be used by the link owner to send them greeting cards through Moments Imprinted. By submitting the form, the Submitter consents to this use of their personal information.

Submissions are held in a pending state until the account holder (you) reviews and approves them. Upon approval, the Submitter's information is added to your recipient list and their birthday (if provided) is automatically scheduled as a card event. You may dismiss any submission you do not wish to add.

Moments Imprinted stores Submitter data in accordance with our Privacy Policy. Submitter data that is dismissed (not approved) is retained for a limited period for abuse prevention purposes and then permanently deleted.

6.4 Sharing and Communication

The Service provides convenience features to share your Collect My Dates link via text message (SMS) and email. When you use these features, the message is sent directly from your device using your default messaging or email application. Moments Imprinted does not send these messages on your behalf, does not have access to your contacts, and does not store the phone numbers or email addresses of the people you share the link with.

You are solely responsible for ensuring that your use of these sharing features complies with applicable laws, including anti-spam regulations (such as the CAN-SPAM Act and TCPA). You agree not to use these features to send unsolicited messages to individuals who have not consented to receive communications from you.

6.5 Link Management

You may deactivate or regenerate your Collect My Dates link at any time through the Recipients page in your dashboard. Deactivating a link prevents new submissions from being accepted. Regenerating a link creates a new unique URL and invalidates the previous one. Previously approved submissions and their associated recipients are not affected by link changes.

7. Intellectual Property

All card designs, illustrations, website content, logos, and other materials provided through the Service are the property of Moments Imprinted or our licensors and are protected by copyright and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the card designs solely for the purpose of sending greeting cards through the Service. You may not reproduce, distribute, modify, or create derivative works from our card designs or other proprietary materials for any other purpose.

8. AI-Designed Artwork & Transparency

8.1 How Our Card Artwork Is Created

Moments Imprinted card artwork is designed using artificial intelligence (AI) image generation technology. Our creative team defines the artistic direction, style parameters, color palettes, and composition guidelines for each card. AI tools then generate artwork based on these specifications. Each design is reviewed, curated, and selected by our team before being added to our card collection.

When we describe our cards as "watercolor-style," "botanical," "minimalist," or use other style descriptors, we are referring to the visual aesthetic and appearance of the artwork, not the physical production method. Our cards are digitally designed and professionally printed on premium cardstock.

8.2 Intellectual Property of AI-Generated Artwork

The AI-generated artwork used in our cards is original to Moments Imprinted. Each design is uniquely created for our platform and is not sourced from stock image libraries or third-party artists. While the legal landscape around AI-generated artwork and copyright continues to evolve, we assert rights over the creative direction, curation, and selection of all designs in our collection.

You are granted a limited license to use these designs solely for the purpose of sending greeting cards through our Service, as described in Section 7.

8.3 AI-Generated Card Messages

The Service offers AI-generated personalized card messages as a convenience. These messages are generated based on information you provide about your recipient, such as their name, your relationship, and the occasion. While we strive to produce appropriate and thoughtful messages, AI-generated content may occasionally be inaccurate, inappropriate, or not reflective of your intent.

You are responsible for reviewing and approving all card content — both artwork and messages — before it is printed and mailed. The 3-week preview email and 1-week editing window are designed to give you ample time to review. Moments Imprinted is not liable for any issues arising from AI-generated content that you have approved for delivery.

8.4 Our Commitment to Transparency

We believe in being upfront about how our products are made. Every card in our collection is designed with AI assistance and printed using professional digital printing. We do not claim that our cards are hand-painted, hand-drawn, or manually illustrated. The back of each card is marked "Designed by Moments Imprinted" to credit the source of the artwork. 9. Content Responsibility & Indemnification

9.1 Your Responsibility for Card Content

You are solely responsible for all content delivered through the Service on your behalf. This includes, but is not limited to, card messages (whether written by you, edited by you, or generated by AI and approved or deemed accepted by you), recipient selection, and delivery instructions.

While our AI message generation system includes content guardrails designed to produce appropriate messages, no automated system is perfect. You are provided with a preview notification and editing window specifically so that you can review and take responsibility for the final content. If you choose not to review a card during the editing window, you accept the content as generated.

9.2 Indemnification

9.3 Moments Imprinted's Role

Moments Imprinted acts as a printing and mailing service that facilitates the delivery of greeting cards on your behalf. We are not the author or originator of the card messages — you are. Our role is to provide the platform, card designs, AI message suggestions, printing, and mailing services. The final decision to send any card rests with you, whether through active approval or deemed acceptance.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Moments Imprinted and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

12. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users or the Service, or is otherwise objectionable. Upon termination, your right to use the Service will immediately cease. Any pending card orders that have already been charged will be fulfilled; unprocessed orders may be cancelled and refunded.

12.1 Voluntary Account Deletion

You may delete your account at any time through your Profile settings. When you request account deletion:

• All personal data (name, email address, physical addresses) is immediately anonymized and replaced with placeholder values.
• Any active membership subscription is cancelled immediately. No further membership fees will be charged.
• All pending card events are cancelled. Cards that have already been printed and mailed cannot be recalled.
• All recipient data is anonymized immediately.
• All Collect My Dates links are deactivated and pending submissions are deleted.
• Referral codes and credits associated with your account are deactivated.
• You will be logged out and will no longer be able to access your account.

12.2 Data Retention After Deletion

After account deletion, your anonymized account record is retained for a 90-day grace period. During this period, no personal information is accessible or recoverable, but the anonymized record is maintained for payment dispute resolution and legal compliance purposes. After 90 days, all remaining records are permanently and irreversibly deleted from our systems.

Payment transaction records may be retained for up to 7 years as required by tax and financial regulations, but these records will not contain any personally identifiable information after the anonymization process.

12.3 Administrative Deletion

We may delete your account as a result of a Terms of Service violation or at your written request. Administrative deletions follow the same anonymization and retention process described above.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless otherwise required by applicable law.
